    2. Payment: Payment for your order must be made in full at the time of purchase, using one of the accepted payment methods on our website. Norman Health reserves the right to cancel or refuse any order for which payment is not received.

  2. SHIPPING AND DELIVERY

    1. Shipping: Norman Health will ship your order to the address provided during the checkout process. Shipping charges will be calculated and displayed during checkout.

    2. Delivery: Delivery times may vary depending on the product, your location, and other factors. Norman Health will provide an estimated delivery date but cannot guarantee a specific delivery date.

  3. RETURNS AND REFUNDS

    1. Returns: In the unlikely event you are experiencing technical problems with a product, you may return the product within 15 days of delivery for a full refund, provided the product is returned to Norman Health.

    2. Refunds: Refunds will be issued in the same form of payment used for the original purchase. Norman Health reserves the right to deduct any shipping and handling charges from the refund amount.

  4. INTELLECTUAL PROPERTY

    1. Ownership: All content, including text, graphics, logos, and images, on the Norman Health website is the property of Norman Health and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content without the prior written consent of Norman Health.

    2. The formulas used in Norman Health’s products are proprietary to and trade secrets of Norman Health and, by purchasing the same through our website, you agree not to duplicate, reverse engineer, or otherwise misappropriate the same.

    3. If you purchase products through our website, you agree that any violation of our intellectual property rights by you may be enjoined by Norman Health, and Norman Health may recover its attorney fees for enforcing its rights, together with any other damages available at law or in equity.

    4. Third-Party Intellectual Property: Norman Health respects the intellectual property rights of others and takes reasonable measures to ensure that all products sold on our website do not infringe upon third-party intellectual property rights.   5. WARRANTIES AND DISCLAIMERS

    1. Product Warranties: Norman Health warrants that all healthcare products sold on our website are free from material defects in materials and workmanship for a period of  90 days from the date of purchase. This warranty does not cover normal wear and tear, or damage caused by misuse, accident, neglect, improper storage, or failure to follow the product use and directions.

    2. Disclaimer of Warranties: EXCEPT FOR THE WARRANTIES IN SECTION 6(a), NORMAN HEALTH MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NORMAN HEALTH DOES NOT WARRANT THAT THE WEBSITE OR ANY CONTENT THEREIN WILL BE UNINTERRUPTED OR ERROR-FREE.

  6. LIMITATION OF LIABILITY

    1. General Limitation: IN NO EVENT SHALL NORMAN HEALTH BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF, OR INABILITY TO USE, THE WEBSITE OR ANY PRODUCTS PURCHASED THROUGH THE WEBSITE, EVEN IF NORMAN HEALTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    2. Monetary Cap: NORMAN HEALTH’S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE WEBSITE OR PRODUCTS PURCHASED THROUGH THE WEBSITE SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE RELEVANT PRODUCT.

    3. Exceptions: Exceptions: Notwithstanding the foregoing, nothing in these Terms and Conditions shall limit or exclude Norman Health’s liability for:

      1. Death or personal injury caused by our negligence;

      2. Fraud or fraudulent misrepresentation;

      3. Any breach of the terms implied by the applicable consumer protection laws; or

      4. Any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

  7. CONFIDENTIALITY AND PRIVACY

    1. Confidentiality: Norman Health will maintain the confidentiality of any personal or medical information you provide in connection with your purchase.

    2. HIPAA Compliance: Norman Health is committed to complying with the Health Insurance Portability and Accountability Act (HIPAA) and will handle all protected health information in accordance with HIPAA regulations. Our HIPAA compliance measures include, but are not limited to:

Severability: If any provision of these Terms and Conditions is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable it shall to the extent of such illegality, invalidity, voidness, voidability, unenforceability or unreasonableness be deemed severable and the remaining provisions of these Terms and Conditions and the remainder of such provision shall continue in full force and effect.

  3. LAW AND DISPUTE RESOLUTION

    1. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Indiana.

    2. Venue and Jurisdiction: Each Party hereby expressly submits to the exclusive jurisdiction of the state courts sitting in Allen County, Indiana or the United States District Court for the Northern District of Indiana.  Each Party hereby irrevocably waives, to the fullest extent permitted by law, any objection that it may have or hereafter have to the laying of the venue of any such proceeding brought in such a court and any claim that any such proceeding brought in such a court has been brought in an inconvenient forum.

    3. Waiver of Jury Trial: Each party hereto expressly waives the right to trial by jury in any proceeding relating to or arising in any way from these Terms and Conditions or the matters contemplated hereby, unless such waiver is prohibited under applicable law.
